Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at hyperreality.digital (the "Site"), operated by 16805418 Canada Inc., doing business as Hyperreality Digital ("we," "us," "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Any engagement for design, development, marketing, or other services is governed by a separate written proposal or service agreement. Those engagement terms control in the event of any conflict with these Terms for matters covered by that agreement.
1. Eligibility
You must be at least 16 years old to use the Site. By using the Site, you represent that you meet this requirement.
2. The Site and its content
The Site provides information about Hyperreality Digital, examples of our work, blog content, and a way to contact us. We may modify, suspend, or discontinue any part of the Site at any time without notice.
The Site, including its text, graphics, logos, photography, video, code, and design, is owned by Hyperreality Digital or its licensors and is protected by copyright, trademark, and other intellectual property laws. Case-study imagery and client work may be owned by the respective clients and is shown with permission.
You may view, print, and download content from the Site for personal, non-commercial reference only. You may not copy, redistribute, republish, resell, or otherwise exploit any content from the Site without our prior written consent.
3. Acceptable use
You agree not to:
- Use the Site in any unlawful way or for any unlawful purpose;
- Attempt to gain unauthorized access to the Site, related systems, or networks;
- Interfere with or disrupt the Site or servers (including via denial-of-service attacks, scraping, or automated use);
- Submit false, misleading, or infringing content via our contact form or email;
- Reverse-engineer, decompile, or attempt to extract the source code of any part of the Site.
4. Submissions via the Site
If you submit ideas, suggestions, or feedback via the Site or email, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use that feedback to improve our services. You represent that your submission does not violate any third-party rights.
5. Third-party links
The Site may link to external sites, including our store (store.hyperreality.digital), social profiles, and scheduling tools. We are not responsible for the content, availability, or practices of third-party sites. Your use of them is at your own risk and is governed by their own terms and privacy policies.
6. Disclaimers
The Site and all content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Site will be uninterrupted, secure, or error-free.
Blog posts, case studies, and other editorial content are shared for general informational purposes and do not constitute legal, financial, or professional advice.
7. Limitation of liability
To the fullest extent permitted by law, in no event will Hyperreality Digital, its directors, officers, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to the Site is limited to CAD $100 or the amount you have paid us in the past 12 months (if any), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
8. Indemnification
You agree to indemnify and hold Hyperreality Digital harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
9. Termination
We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
10. Changes to these Terms
We may update these Terms from time to time. We will revise the "Last updated" date above. Material changes may also be announced on the Site. Your continued use of the Site after a change constitutes acceptance of the revised Terms.
11. Governing law and venue
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the courts located in Ontario, Canada, and you consent to personal jurisdiction there. Nothing in this section limits any mandatory consumer-protection rights you may have under the law of your own place of residence.
12. Privacy
Your use of the Site is also governed by our Privacy Policy.
13. Entire agreement
These Terms, together with our Privacy Policy and any written engagement agreement, constitute the entire agreement between you and Hyperreality Digital regarding the Site. If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force.
